iMemento.eu website terms and conditions

 

The subject matter of these rules is the principles of functioning and use of the iMemento.eu website. Beginning to use the service is tantamount to acceptance of the terms and conditions contained in the terms and conditions.


 

  1. GENERAL PRINCIPLES

1.1 The service is owned by N-ideas Łukasz Markowicz with its registered office in Bielsko-Biała, at Wczasowa 63, NIP 9372745244.
1.2 The purpose of iMemento.eu is:

a). providing users with access to materials published on iMemento.eu,
b). enabling the storage and self-editing of material (text, images, video, etc.), commenting on other users' material,
c). providing an opportunity to commemorate loved ones who have passed away,


  1. DEFINITIONS

    2.1 Service – the Imemento.eu website, operating under the internet address https://www.imemento.eu.
  2. 2.2 Administrator – the company N-ideas Łukasz Markowicz, which provides the service of making the resources of the Website available to its Users free of charge.
  3. 2.3 User – any person who has access to the Service, uses its functionalities, receives content published on the Service and posts his/her own content. A User is a person to whom the provisions of these Terms and Conditions apply.
  4. 2.4 Registered User – a User who has registered.
  5. 2.5 Material – all material (text, images, videos, links, opinions, comments, as well as other material submitted as being intended for publication on the Website) that the User may post on the Website using the functionalities provided.
  6. 2.6 Rules and Regulations – these Rules and Regulations.
  7. 2.7 Registration – registration on the Website, performed by the User after providing his/her e-mail address and a unique password, which is entered each time he/she logs in.
  8. 2.8 Image – a current photograph of the User posted on iMemento.eu and on the subpages where User Submissions are published.
  9. 2.9 Memory – An entry published by a User on the iMemento.eu website using the creator made available by the website.

  11. USER RIGHTS AND OBLIGATIONS

3.1 The User is obliged to use the Service in a way that does not infringe the rights of third parties, the rules of social coexistence and the provisions of these Terms of Use. Furthermore, the User is obliged to use the Website in a manner consistent with its purpose and the provisions of these Terms of Use.
3.2 The User is obliged to refrain from any action that could in any way interfere with the functioning of the Service, be a nuisance to other Users and to the Administrator.
3.3 Registration on the Website is voluntary and free of charge. The user registers by completing the form available at: https://www.imemento.eu/signup/. Registration on the Website means that the User accepts the provisions of these Regulations. Only registered Users may use certain functionalities of the Website, e.g.: adding and editing Memories, photos, videos, links.
3.4 The user can cancel the registration by sending a message via the form available at: https://www.imemento.eu/contact/. The Administrator undertakes to delete the User's data from the iMemento.eu database and to cease processing them within a maximum of 30 days, with the Materials posted by the User still remaining on the Website.
3.5 The User declares that, by publishing Materials featuring the image of other persons, he/she has their permission to disseminate their image.
3.6 There is no permission for:

a). any activity that violates the privacy of other Users, especially the collection, processing and dissemination of information about other Users, unless the User has consented to it, it is permitted by law or the provisions of these Terms and Conditions,
b). posting content that is not related to the profile and themes of the Website,
c). impersonating other Users, suggesting a false identity by the User, or creating false Memories,
d). sending spam and commercial information not solicited by the Administrator,
e). uploading content of a pornographic or racist nature, inciting acts of violence or spreading hatred on grounds of race, religion, nationality ect.

3.8 If a User breaks the provisions of these Regulations, the Administrator has the right to limit, permanently or temporarily, the User's access to the iMemento.eu website or to some of its functionalities. The Administrator is also entitled to disallow Memories which break the Terms and Conditions, or to deactivate Memories, without being obliged to return the fee to the User.
 3.9 The Administrator shall have the right to remove from the Service any material which in any way violates the provisions of these Regulations, without prior notice to the User.

  2. MATERIALS

4.1 A User who has registered may independently add and edit Materials, i.e. photos, texts, films, etc., to the Website. Comments under Materials published on the Website may also be added by unregistered Internet users.
4.2 The Administrator reserves the right to block or delete comments and opinions, the content of which violates the provisions of these Regulations without prior notice to the User. The owner of Memories has the right to delete unwanted comments and to disable commenting altogether.
4.3 Each Material posted by a User is checked for content and language by a person appointed by the Administrator. Only after approval, the text will be published on the Service.
4.4 You are prohibited from posting Materials on iMemento.eu that contain:

a). content contrary to national and international law,
b). content inciting hatred based on differences of nationality, ethnicity, race, religion or non-denominational grounds,
c). pornographic content, incitement to violence, depictions of violence,
d). content that violates the privacy rights of others.

4.5 The Administrator reserves the right to block and remove content commonly regarded as SPAM, containing advertisements for goods, services, commercial sites or content that may be considered competitive in relation to iMemento.eu or may be detrimental to the Website.
4.6 The Administrator has the right to refuse to publish Material in the event of:

a). detection of plagiarism,
b). previous publication of the same Materials on the Website,
c). the low factual and linguistic level of the Submissions,
d). violation by the Materials of the provisions of these Terms and Conditions, the law, the welfare of third parties.


4.7 The Administrator stipulates that he is not liable for the materials posted by the User on the iMemento.eu website and for any potential damage that their publication on the Website might cause to third parties.
4.8 The Administrator shall not be held liable for the complete or partial copying of the Materials available on the Website by third parties, or for their posting or use in any way on other websites.

4.9 The Administrator is obliged to maintain the memories on the Website for a minimum period of 20 years*.

 

  1. COPYRIGHT/LICENCE

5.1 The User declares that he/she owns all rights, including in particular copyrights, to the Materials that he/she uploads to the Service. At the same time, the User declares that his/her materials are free from legal defects and do not infringe any rights of third parties or other entities.
5.2 By registering and posting Materials on iMemento.eu, the User gives the Administrator his/her consent to use them in the following fields of exploitation (licence):

a). within the scope of recording and multiplication of the work - production of copies of the work by a specified technique, including printing, reprography, magnetic recording and digital technique,
b). within the scope of circulation of the original or copies on which the work has been fixed - introduction into the market, rental of the original or copies;
c). within the scope of dissemination of the work in a manner other than specified in point. 2 - public performance, exhibition, display, reproduction, broadcasting and re-broadcasting, as well as making a work available to the public in such a way that everyone can have access to it at a place and time chosen by themselves.

5.3 The licence is non-exclusive, granted for an indefinite period and free of charge. The licence is granted in respect of each work separately, upon its submission to the Service.
5.4 The User, by posting his/her Materials on iMemento.eu, authorises the Administrator or the Administrator's designated persons to make changes to the Materials, in particular: titles, sub-titles, subtitles, abbreviations, stylistic or language corrections, use of parts of texts or their supplementation.
5.5 The user shall be solely and exclusively liable in the event that the above statements prove to be factually incorrect or in the event of possible claims by third parties.

PAYMENTS

6.1 The amount of the Paid Service is a gross amount and the Paid Services Administrator does not add any additional fees. This amount includes all activities on the part of the Paid Services Administrator covered by the offer selected by the User.
6.2 In order to receive an invoice for the service provided by the Payable Services Administrator to the Payable Services User, the Payable Services User shall, within 14 (fourteen) days from the conclusion of the contract, inform one of the Payable Services User's chosen contact channels to the Payable Services Administrator of its wish to obtain an invoice. For the correct preparation of the invoice, the User of the Paid Services must provide the Paid Services Administrator with the necessary data for the invoice.
6.3 You can pay for the ordered services by the following methods:

  2. 6.4 The administrator is obliged to post the mention on the site within 3 days after receipt of payment.
  3. 6.5 Administrator shall send a registered letter with the ordered item within 7 days of receipt of payment.

  6. COMPLAINTS AND RETURNS

7.1 Complaints about services provided by iMemento.eu may be filed in writing to N-ideas Łukasz Markowicz ul. Wczasowa 63 Bielsko-Biała 43-310
7.2 The written complaint should contain the name, surname, exact address, telephone number, a detailed description and the reason for the complaint.
7.3 Complaints will be dealt with within 14 days of receipt by a specially appointed Complaints Committee.
7.4 Notification of the complaint resolution will be sent by registered mail within 7 days of the Complaints Committee's decision.
7.5 The user has the right to withdraw from the contract without stating a reason within 14 days of taking possession of the contractual object.
7.6 The User may submit a declaration of withdrawal by e-mail to office@imemento.eu. The product must be returned in unaltered condition with no signs of use and in the company packaging, together with proof of purchase (receipt or VAT invoice). Costs for returning the goods to the shop are not refundable.
7.7 If the User withdraws from the contract, the Administrator is entitled to remove all memories covered by the contract from the service.
7.8 The Administrator shall refund the payment using the same method of payment used by the User, unless the User has expressly agreed to a different method of payment that does not incur any costs for the User.
7.9 The Administrator may withhold reimbursement of the payment received from the User until it has received the item back or the User has provided proof of its return, whichever event occurs first.

 

  1. FINAL PROVISIONS

8.1 These Terms and Conditions are available at the registered office of N-ideas Lukasz Markowicz.
8.2 The Administrator reserves the right to unilaterally amend these Terms and Conditions.
8.3 The User's use of the Website after the amendments to the Terms and Conditions have been made shall constitute acceptance thereof.
